MD Web Solutions – Terms & Conditions

These Terms & Conditions (“Terms”) apply to all services provided by MD Web Solutions. By purchasing or using our services, you agree to these Terms.

MD Web Solutions is a trading name of Mark Dudley, a sole trader operating in the United Kingdom.

1. About MD Web Solutions

MD Web Solutions provides:

  • Fully managed websites using a Website-as-a-Service (WaaS) model, and
  • One-off website repair and fix services

Services are provided to small businesses and organisations in the United Kingdom.

2. The Service – Website Build (Managed Websites)

A one-off setup fee of £0–£500 (depending on the selected plan) covers the initial design and build of your website.

Websites are typically designed and prepared for preview within 14 days once all required content (including text and images) has been received and approved by the client.

Delivery timelines may be extended if required information, feedback, approvals, or content are delayed.

3. Website-as-a-Service (Important)

MD Web Solutions operates on a website-as-a-service basis. This means:

  • An active subscription is required to keep the website live
  • If the subscription is cancelled or payment fails, the website will be taken offline
  • The setup fee does not include lifetime hosting or permanent ownership
  • When the subscription ends, the service stops

4. Revisions & Changes (Managed Websites)

Each website build includes 1–2 rounds of revisions, depending on the selected plan.

Revisions cover reasonable adjustments to the agreed content.

Changes outside the agreed scope may require additional fees.

Post-launch content updates are included in line with the client’s selected plan. Additional changes outside the included updates may be quoted separately.

5. Client Responsibilities

You agree to:

  • Provide accurate and complete information
  • Ensure you have the legal right to use any supplied content
  • Respond promptly to feedback and approval requests
  • Ensure all content complies with applicable laws and regulations

Delays in providing content or feedback may affect delivery timelines.

6. Payments

A 50% deposit of the website build cost is required before work begins for managed website builds.

Once work has started, the deposit is non-refundable, as the website is custom-built specifically for the client.

The remaining 50% of the build cost is payable once the website build has been completed and approved by the client.

Websites will not be made live until the final build payment has been received and an active managed service subscription is in place.

Subscriptions are billed in advance.

Full Payment is required upfront for Website Fixes & Quick Help

Failed payments may be retried before service suspension.

7. Cancellations

Subscription (Managed Websites)

You may cancel your subscription at any time.

Your website will remain live until the end of the current billing period, after which it will be taken offline.

No refunds are issued for unused subscription time.

Rolling Monthly Service

Monthly services are provided on a 30-day rolling basis. There are no long-term contracts.

You may cancel your subscription at any time by giving at least 30 days’ notice in writing. Service will continue, and fees will remain payable, until the end of the notice period.

Setup Fee

Refunds for setup fees apply only where covered by any stated money-back guarantee.

8. Ownership, Domains & Use

While your subscription is active, you are granted the right to use your website.

Any domain registered as part of the service will be registered in the client’s name, and the client will remain the domain owner. As part of the managed service, MD Web Solutions will handle domain setup, renewals, and day-to-day management.

Newly registered domains or domains with recent changes may be subject to a standard transfer lock period (typically up to 60 days), during which the domain cannot be transferred to another registrar. This is an industry-standard requirement and is outside of MD Web Solutions’s control.

MD Web Solutions retains ownership of all underlying systems, templates, frameworks, and technical configurations used to deliver the service.

Client-supplied content remains the property of the client.

Resale, redistribution, or reuse of the website or its components outside the service is not permitted.

9. Acceptable Use

Websites must not be used for illegal, harmful, misleading, or infringing activities, including but not limited to:

  • Illegal activities
  • Fraud, scams, or misleading practices
  • Harmful, abusive, or offensive content
  • Infringement of third-party rights

MD Web Solutions reserves the right to suspend or terminate services for breaches of this section.

10. Limitation of Liability

To the maximum extent permitted by law, MD Web Solutions is not liable for:

  • Loss of profits, revenue, or business opportunities
  • Indirect or consequential losses
  • Issues caused by third-party services outside our control

MD Web Solutions’s total liability is limited to the fees paid by the client in the previous 12 months.

11. Service Availability

Uninterrupted service is not guaranteed.

Downtime may occur for maintenance, updates, or external factors outside MD Web Solutions’s control.

12. Changes to the Service or Terms

MD Web Solutions may update services, pricing, or these Terms from time to time.

Material changes will be published with reasonable notice where possible.

13. Termination

Services may be suspended or terminated if:

  • Payments are not made
  • These Terms are breached
  • The service is misused

14. Governing Law

These Terms are governed by the laws of England and Wales.

16. One-Off Website Repairs

MD Web Solutions also offers one-off website repair and fix services, separate from the managed Website-as-a-Service subscription.

One-off repair services are limited strictly to the specific issue(s) agreed in writing before work begins. Once the agreed work has been completed and delivered, the service is considered fulfilled.

One-off repair services do not include:

  • Ongoing support or maintenance
  • Future updates or fixes
  • Hosting, backups, or monitoring
  • Responsibility for unrelated or pre-existing issues

Payment for one-off repair work is required in full before work begins, unless otherwise agreed.

Clients are responsible for ensuring suitable backups are available before one-off repair work begins, unless backup services are explicitly included as part of the agreed work.

MD Web Solutions is not responsible for issues caused by:

  • Third-party software, themes, plugins, or platforms
  • Existing site configurations or hosting environments
  • Future updates, changes, or external factors after the repair is completed

Where possible, reasonable care will be taken to avoid disruption. However, no guarantee is provided that repairs will permanently resolve all issues, particularly where third-party systems are involved.

Any further work required after completion will be treated as a new request and may be quoted separately.
